Syracuse College Football Rewards Prize Draw Terms & Conditions
Participation in each of the Tier 3,6 and 8 Prize Draw competition implies the acceptance of and compliance with the following conditions:
1.- ORGANIZING COMPANY AND AIM
1.1. Fantastec Sports Technology Ltd (company number 10757008), hereinafter: “the organizer” and/or “Fantastec”) has organized the following Prize Draws:
Syracuse College Football Tier 3 Prize Draw. (In app described as Syracuse Football for brevity)
Syracuse College Football Tier 6 Prize Draw. (In app described as Syracuse Football for brevity)
Syracuse College Football Tier 8 Prize Draw. (In app described as Syracuse Football for brevity)
1.2. The aim of each of the Prize Draw competitions organized by Fantastec is to hold three separate prize draws to win a selection of merchandise items and signed merchandise items.
Should it prove impossible to deliver the aforementioned prizes over to the selected winners of each of the three prize draws, or reserve winners, Fantastec reserves the right to provide a different selection prizes of equal value.
1.3. The competition is regulated by these specific rules which can be accessed via the Fantastec Swap app Syracuse Football for the 2022 season Rewards, and the respective Tier 3,6 or 8 Entryboard. By entering each Prize Draw competition, any natural person implies the unconditional acceptance of these rules.
1.4 Each of the Tier 3, 6 and 8 Prize Draws are administered and run by the Promoter, Fantastec SWAP and is not in any way sponsored, endorsed or administered by, or associated with Apple or Google, or Syracuse University, Syracuse University Athletics Department or Syracuse University Football team or any of its athletes and coaches.
You acknowledge that neither Apple Inc, Google, Syracuse University, Syracuse University Athletics Department or Syracuse University Football team or any of its athletes and coaches shall not have any liability to you in connection with any of the Prize Draws. The Promoter reserves the right to disqualify any entrant posting an entry or a comment to the Promoter’s email address that is, in the Promoter's opinion, inappropriate, offensive or upsetting to other entrants, fans of the Promoter or directly aimed at the promoter, or contrary to applicable law, and to remove any such entry or comment.
2.- ENTRY REQUIREMENTS
2.1. In order to enter any of the Syracuse Football Tier 3,6 or 8 Prize Draws participants must be over the age of 16 (16) on the date on which the competition opens, and have downloaded the Fantastec SWAP app and sign up to a full account to provide an email address where you can be contacted in the event you are selected as a winner.
2.2. To participate, entrants must take the following steps:
1.- STEP 1 - Acquire Syracuse College Football Collectible NFTs through pack purchases or through the marketplace. Each collectible NFT has a ‘points value’ relative to its scarcity and rarity level. As Collectible NFTs become owned, the users’ points score increases and they are able to progress further along the rewards ladder. At certain ‘Points Score’ targets, the user will be eligible to participate in each of the three Prize Draws at Tier3, Tier 6 and Tier 8 respectively.
2. STEP 2 - Reach 250 Points across 2022 Syracuse College Football collections.
3. STEP 3 - Enter the Tier 3 Prize Draw before 11.59pm on 21st October 2022 GMT (7pm EST).
4. STEP 4 - Reach 2000 Points across 2022 Syracuse College Football collections.
5. STEP 5 - Enter the Tier 6 Prize Draw before 11.59pm on 21st October 2022 GMT (7pm EST).
6. STEP 6 - Reach 5000 Points across 2022 Syracuse College Football collections.
7. STEP 7 - Enter the Tier 8 Prize Draw before 11.59pm on 21st October 2022 GMT (7pm EST).
2.3. For the purposes of each Prize Draw competition, only entrants who have completed all steps outlined, and whose usernames can be seen as ‘entered’ on the respective Tier Prize Draw Entry Board, will be considered as being valid. Every validated user who has a valid entry will have an entry date and time by their username in the Entry board.
2.4. Participants who do not fulfill the requirements stated in this legal basis will not have any rights to claim Prize Draw prizes.
2.5. The Directors and employees of Fantastec, or their direct family members, or the Directors or employees of intermediary companies cannot take part in the competition, be it directly or indirectly.
2.6. Entries must be made personally by the individual entering each of the Tier 3, Tier 6 or Tier 8 Prize Draw competitions. Under no circumstances will entries made by third parties be accepted.
3. TIER PRIZES AND PRIZE VALUE
3.1 Each of the three Prize Draws at reaching the Tier 3, Tier 6 and Tier 8 points score target respectively, will make available three groups of exclusive prizes to be won through each Prize Draw by those users who have successfully entered and are validated on the respective Tier 3,6 or 8 Entry Board.
3.2 The prizes that are available to be won through the respective Tier 3,6 and 8 Prize Draws are as follows:
TIER 3 Prize Draw: One Syracuse College Mini Football Helmet, signed by one Cuse College football athlete. Runners Up prizes of four Syracuse college T-shirts. The collective retail value of this prize is approximately $300.
TIER 6 Prize Draw: One Syracuse College Football Jersey signed by athletes from the 2022 Syracuse College Football team. Runners Up prizes of four Syracuse College Hoodies. The collective retail value of this prize is approximately $600.
TIER 8 Prize Draw: One Syracuse College Football Helmet, signed by athletes from the 2022 Syracuse College football team. Runners Up prizes of four Syracuse College football Jerseys. The collective retail value of this prize is approximately $1,000.
4.- ENTRY CALENDAR AND GEOGRAPHICAL LIMITS OF THE COMPETITION
Competition entries are not restricted to any geographical area and the competition opens at 12pm GMT on Friday 30th September and will be open for user entries until 11.59pm on Friday 21st October GMT (7pm EST).
5. HOW THE COMPETITION WORKS
5.1. The Prize Draws for each of the Tier 3,6 and 9 Prize Draws, will be held between 24th October 2022 and 28th October 2022. Fantastec reserves the right to change the date of the draw at its convenience.
6. WINNERS
6.1. When each of the Prize Draws close on 21st October 2022 (see section 4), a draw for each Tier 3,6 and 8 Prize Draws will be conducted selecting 5 random usernames from the list of validated entries for each Prize Draw. A further 5 usernames will be selected as ‘reserve winners’ should any of the first picked winners not respond within a specified time following the publishing of their usernames as winners on the SWAP app News Feed.
Reserve winners will replace winners in chronological order of when their usernames were randomly selected.
All Tier Prize Draws of usernames (winners and reserve winners) will be recorded for transparency purposes and shared on Fantastec SWAPs Discord Channel.
6.2 ALLOCATION OF PRIZES IN EACH TIER PRIZE DRAW
The first valid username drawn in each of the Tier 3,6 and 8 Prize Draws will receive the top prize of the ‘signed Syracuse College Football item. For clarity as defined in clause 3:
Tier 3: Signed Mini Football Helmet
Tier 6: Signed Syracuse Football Jersey
Tier 8: Signed Syracuse Football Helmet One (1) provisional winner of the prize.
If the selected winner (first randomly drawn username) does not claim their prize by contacting Fantastec after the winners names have been published, the second username drawn from the winners list will be eligible to claim the prize. If the second winner does claim the prize then the first reserve winner will replace the second winner and be eligible for one of the four runners up prizes in each of the Tier Prize Draws. The runner’s up prizes for clarity and as referenced in clause 3 are as follows:
Tier 3: Syracuse College T shirt (four available, one for each of four winners)
Tier 6: Syracuse College Hoodie (four available, one for each of four winners)
Tier 8: Syracuse Football Jersey (four available, one for each of four winners).
If the second winner also fails to claim their prize within the specified time limits then this will pass to the third winner and so on with reserve winners replacing the winning positions as defined above in chronological order.
Should in the unlikely event all the main winners and any of the five reserve winners not make themselves available to claim their Tier Prize, then a second recorded random draw will take place to select further winners and follow the same process once more.
6.3. Fantastec will inform the winners of the results of the draw and how and when they will be able to collect their prize, via email. The winners will have twenty-four (48) hours to claim their prize.
6.4. In the event that any Prize Draw winner rejects the prize awarded, said prize shall go to the next reserve winner to have come out of the draw.
6.5. The winner may reject the prize, but under no circumstances can the prize be exchanged for a cash, crypto or NFT alternative.
7. INTELLECTUAL PROPERTY
Entrants to the competition freely grant Fantastec any sort of rights which they may be entitled to in relation to the information presented for the competition through their profile, and in particular the rights of reproduction, distribution, communication to the public, disclosure, and putting it at the disposition of the public, as well as the right of adaptation, including on the telecommunication networks and the internet for everyone's consumption and its entry into the public domain, with the organizing committee being able to grant and transfer this information via any medium and also allowing third parties to license these rights.
8. CAVEATS AND LIMITATIONS
8.1. Under no circumstances do the pages or profiles of entrants represent Fantastec, and as such, Fantastec is not responsible for the content published on them.
8.2. Fantastec reserves the right to delay, cancel, change the rules, repeat or terminate the competition at any time in the event of exceptional circumstances, whilst informing of these circumstances in such a way so that they do not prove detrimental to the entrants in any way.
8.3. Non-compliance with any of the basis laid down herein shall give the organizer of the competition full discretion to disqualify the entrant at any time; likewise, the organizer reserves the exclusive right to reject the right for entrants to take part if they consider that the conditions established here have been infringed upon.
8.4. In the event that the organizer has reasonable suspicions that an entrant has committed fraud, manipulation, has been dishonest or does not meet the entry requirements, they shall refuse to award the prize which has been won or disqualify the entrant.
8.5. In the event of an error, a misunderstanding or conflict in relation to the way any element of the competition works, or with the behavior of an entrant, the decision made by the organizer in this regard will be definitive and final.
8.6. The organizer reserves the right to take the necessary decisions to ensure that the competition runs smoothly, with these being expressly accepted by all entrants.
8.7. In no way shall the organizer be responsible for the non-compliance or any type of infraction relating to this competition and shall not be held liable in the event of losses suffered by entrants caused by the prizes or any other aspects of the competition.
8.8. Likewise, the organizer shall not be held liable for damages suffered by an entrant arising from their enjoyment of the prize.
8.9. The entrant exempts the organizer of all liability and shall indemnify them against any claims as a result of the damages which may arise from activities carried out with the awarded prize.
9. OTHER CAVEATS
9.1. The organizer reserves the right to use the SWAP username, winner names, surnames and the images of the entrants, to reproduce them and use them in any advertising and promotional activities related to the competition without this usage involving any right to payment or any type of benefits.
9.2. The organizer may use the SWAP usernames, winner names, surnames and images of the entrants on its web site and in other media as it sees fit.
10. PERSONAL DATA
The data controller for your data is Fantastec Sports Technology Ltd (company number 10757008). Your personal data will be processed for the primary purpose of managing your participation in the competitions, including the award of the prize, as well as for sending personalized commercial communications related Fantastec products and services.
In regard to the sending of commercial communications related to products and services related to Fantastec, provided that this is carried out by electronic means, it will be legitimate in terms of satisfying Fantastec legitimate interests in accordance with article 21 of Law 34/2002, of July 11, on information society services and electronic commerce, as well as the European Regulation on Electronic Commercial Communications.
Additionally, and providing you give us your consent, Fantastec will proceed to communicate your personal information to collaborators and sponsors of the Syracuse University for the development of commercial activities (via email, mailing, fax, SMS, email and any telematic means) both of a general nature and those adapted to your personal characteristics.
We likewise inform you that Fantastec reserves the right not to use the content published by the user participants in the Prize Draws when said content is inadequate or offensive. In no case will Fantastec take responsibility for the content published by the participants, being the participants the only ones responsible for the damages and losses that the inappropriate content of the profiles could cause Fantastec or any third party.
You may access, rectify and erase your data, or oppose certain uses thereof via email, as well as exercise other additional rights that are explained in the detailed data protection information by addressing an email to swap_support@Fantastec.io.
