Legal bases of the sweepstakes: “Slam Dunk Sweepstakes”
NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
Participation in this sweepstakes implies the acceptance of and compliance with the following conditions:
1.- ORGANISING COMPANY AND AIM
1.1. Fantastec Sports Technology Ltd (company number 10757008), hereinafter: “the Sponsor” and/or “Fantastec”) has organised the following sweepstakes: “Slam Dunk Sweepstakes” (hereinafter “the Sweepstakes”).
1.2. The aim of the Sweepstakes organised by Fantastec is to hold a prize draw for tickets outlined in 5.4. Should it prove impossible to hand the aforementioned prize over to the winner or reserve winner, Fantastec reserves the right to provide a different prize of equal or greater value.
1.3. The Sweepstakes is regulated by these specific rules which may be accessed via the application Fantastec SWAP. By entering the Sweepstakes, any natural person implies the unconditional acceptance of these rules.
1.4. All the information relating to the Sweepstakes (its conditions and legal basis, instructions about the way the Sweepstakes works, its Sponsors, prizes and schedules) can be found in the publicity space designed for the consultation of these legal bases.
1.5 The Prize Draw is administered and run by the Promoter and is not in any way sponsored, endorsed or administered by, or associated with NCAA, ACC or Big Ten Conference. You acknowledge that NCAA, ACC, Big Ten Conference shall not have any liability to you in connection with the Prize Draw. The Promoter reserves the right to disqualify any entrant posting an entry or a comment to the Promoter’s email address that is, in the Promoter's opinion, inappropriate, offensive or upsetting to other entrants, fans of the Promoter or directly aimed at the promoter, or contrary to applicable law, and to remove any such entry or comment.
2. TIMING: The Sweepstakes opens at 12:00:01 AM Eastern Time (“ET”) on February 12, 2023. To enter for a chance to win a Tournament Prize, entries must be submitted and received between 12:00:01 AM ET on February 12, 2023 and 11:59:59 PM ET on February 23, 2023 (the “Tournament Prize Entry Period”). To enter for a chance to win a Grand Prize, entries must be submitted and received between 12:00:01 AM ET on February 12, 2023 and 11:59:59 PM ET on the March 12, 2023 (the “Grand Prize Entry Period”).
3.- ENTRY REQUIREMENTS
3.1. In order to enter the Sweepstakes participants must be at least 18 years of age as of 02/12/23, and their personal information must be correctly provided at the time of entry. One (1) completed basketball collection as detailed below equals one (1) entry into the Sweepstakes. Multiple entries are allowed via completing multiple collections and entering.
3.2. Entry Method #1: Basketball Collection Entry (“Collection Entry”) To participate, entrants must complete the following steps:
1.- Download the SWAP App, available for Apple here or for Android here and complete a profile and sign up as a full user.
2.- Purchase collectibles within the SWAP app for one of the eligible US college sports basketball collections listed in the Team and Prize Chart below.
3.- Complete a basketball collection for one of the teams listed in the Team and Prize Chart below (progress to completion noted in the progress indicator within the Team’s page in the SWAP app). Upon completion of a basketball collection, the “Enter Now” button will become active.
4.- Click the “Enter Now” button to earn one (1) entry into the drawing for the corresponding Tournament Prize and one (1) entry into the drawing for the corresponding Grand Prize as listed in the Team and Prize Chart below.
5.- Participants may complete additional collections for additional entries into the other prize drawings.
3.3. Entering the Sweepstakes is free of charge.
3.4. Entry Method #2: Free, Alternate Method of Entry. To enter without purchasing collectibles or completing a basketball collection, email competitions@fantastec.io with the subject line ‘Slam Dunk Sweepstakes’ and in the body of the email state your full name, age as of 2/8/23, address and one (1) team from the basketball collection list in the Team and Prize Chart above to receive one (1) entry into the drawing for that Team’s corresponding Tournament Prize and one (1) entry into the corresponding Grand Prize.
3.5. Limit: One (1) entry per person per basketball collection for a maximum of one (1) entry into the drawing for each Tournament Prize, four (4) entries per person into the drawing for the Grand Prize – Men’s and four (4) entries per person into the drawing for the Grand Prize – Women’s, regardless of method of entry. All methods of entry have an equal chance of winning. Entries become the property of the Sponsor and will not be acknowledged or returned.
3.6. For the purposes of the Sweepstakes, only entrants who have completed all steps outlined will be considered as being valid. Inaccurate information or forms submitted after the set deadline will not be accepted.
3.7. Participants who do not fulfil the requirements stated in this legal basis will have no right to claim the prize.
3.8. The Directors and employees of Fantastec, or their immediate family members, or the Directors or employees of its respective subsidiaries, affiliates, advertising and promotion agencies, cannot take part in the Sweepstakes, be it directly or indirectly.
3.9. Entries must be made personally by the individual entering the Sweepstakes, under no circumstances will entries made by third parties be accepted.
3.10. IMPORTANT: MESSAGE AND DATA RATES MAY APPLY TO USE OF A MOBILE PHONE/DEVICE TO PARTICIPATE IN SWEEPSTAKES.
4.- TERRITORIAL LIMITS OF THE SWEEPSTAKES
The Sweepstakes is open to legal residents of the 50 United States states and District of Columbia. Void in Puerto Rico, Guam, the U.S. Virgin Islands, outside the U.S., and wherever else prohibited by law.
5. HOW THE SWEEPSTAKES WORKS
5.1. To participate in the Sweepstakes, entrants need to complete a basketball collection within the SWAP app and enter that collection as an entry into the Sweepstakes or completing an AMOE Entry following the steps in section 3 – Entry Requirements, above.
5.4. Prizes/Approximate Retail Value (“ARV”):
First Prize – Men’s: There is one (1) First Prize – Men’s available to be won consisting of two (2) tickets to the Men’s Big Ten Tournament in Chicago, IL from March 8, 2023 to March 12, 2023 and $1000 awarded in the form of a check. ARV of the First Prize – Men’s: $1,700.
First Prize – Women’s: There is one (1) First Prize – Women’s available to be won consisting of two (2) tickets to the Women’s Big Ten Tournament in Minneapolis, MN from March 1, 2023 to March 5, 2023 and $1000 awarded in the form of a check. ARV of the First Prize – Women’s: $1,250.
Second Prize – Men’s: There is one (1) Second Prize – Men’s available to be won consisting of two (2) tickets to the Men’s ACC Tournament in Greensboro, NC from March 7, 2023 to March 11, 2023 and $1,000 awarded in the form of a check. ARV of the Second Prize – Men’s: $1,450.
Second Prize – Women’s: There is one (1) Second Prize – Women’s available to be won consisting of two (2) tickets to the Women’s ACC Tournament in Greensboro, NC from March 1, 2023 to March 5, 2023 and $1,000 awarded in the form of a check. ARV of the Second Prize – Women’s: $1,200.
Grand Prize – Men’s: There is one (1) Grand Prize – Men’s available to be won consisting of two (2) tickets* to the Men’s NCAA Final Four in Houston from April 1, 2023 to April 3, 2023 and $2000 awarded in the form of a check. ARV of the Grand Prize – Men’s: $3,000.
Grand Prize – Women’s: There is one (1) Grand Prize – Women’s available to be won consisting of two (2) Tickets* to the Women’s NCAA Final Four in Dallas, TX from March 31, 2023 to April 2, 2023 and $2,000 awarded in the form of a check. ARV of the Grand Prize – Women’s: $2,700.
The total ARV of all prizes available to be won: $11,300.
Tickets are not redeemable for cash and will not be replaced if lost or stolen. Tickets are subject to issuers complete terms and conditions. In the event that an event does not take place as scheduled, for reasons such as cancellation, preemption or postponement, or for any reason beyond the control of the Sponsor, Sponsor's sole responsibility will be to award the remaining portion of the prize and no additional substitution or compensation will be provided.
Should it prove impossible to hand the aforementioned prize over to the winner or reserve winner, Fantastec reserves the right to provide a different prize of equal value.
5.5. The potential First Prize - Men’s, First Prize – Women’s, Second Prize – Men’s and Second Prize – Women’s winners will be selected in a random drawing to be conducted by Sponsor on or around February 24, 2023 from among all eligible entries received during the Tournament Prize Entry Period. The potential Grand Prize -Men’s and Grand Prize – Women’s winners will be selected in a random drawing to be conducted by Sponsor on or around March 13, 2023 from among all eligible entries received during the Grand Prize Entry Period. Fantastec reserves the right to alter the date of the draw at its convenience.
6. WINNERS
6.1. For each random drawing(see section 4), the following winners and reserve winners for each prize will be chosen as the winners of the prize in the current Sweepstakes:
• One (1) provisional winner of the prize.
• Two (2) provisional reserve winners.
6.2. Fantastec will inform the winners of the results of the draw and how and when they will be able to collect their prize via email. The winners will have twenty-four (24) hours to claim their prize. Upon responding to the initial notification, potential winner will be notified via email and/or phone and will be required to sign and return, within 48 hours of notification, an Affidavit of Eligibility, a Liability Waiver, an IRS W-9 Form and where allowable, a Publicity Release (collectively, "the Releases"). These Releases will require the Grand Prize winner to furnish his/her Social Security Number for the sole purpose of tax reporting, as required by law. Noncompliance will result in disqualification and an alternate winner may be selected. The prize package will be awarded within approximately seven days after the winner is verified.
6.3. In the event that the winner does not reply to the email or they do not get in touch to claim their prize by the specified deadline, or if they reject the prize to be awarded in this Sweepstakes, said prize shall go to the next reserve winner to have come out of the draw.
6.4. The winner may reject the prize and may request the prize be exchanged for the monetary value as stated in Section 5.4
6.5. If a winner is otherwise eligible under these Official Rules but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian who will be required to execute and return the Releases on minor’s behalf, as applicable,
7. INTELLECTUAL PROPERTY
Entrants to the Sweepstakes freely grant Fantastec any sort of rights which they may be entitled to in relation to the information presented for the Sweepstakes through their profile, and in particular the rights of reproduction, distribution, communication to the public, disclosure, and putting it at the disposition of the public, as well as the right of adaptation, including on the telecommunication networks and the internet for everyone's consumption and its entry into the public domain, with the organising committee being able to grant and transfer this information via any medium and also allowing third parties to licence these rights.
8.- CAVEATS AND LIMITATIONS
8.1. Under no circumstances do the pages or profiles of entrants represent Fantastec, and as such, Fantastec is not responsible for the content published on them.
8.2. Fantastec reserves the right to delay, cancel, change the rules, repeat or terminate the Sweepstakes at any time in the event of exceptional circumstances, whilst informing of these circumstances in such a way so that they do not prove detrimental to the entrants in any way.
8.3. Non-compliance with any of the basis laid down herein shall give the Sponsor of the Sweepstakes full discretion to disqualify the entrant at any time; likewise, the Sponsor reserves the exclusive right to reject the right for entrants to take part if they consider that the conditions established here have been infringed upon.
8.4. In the event that the Sponsor has reasonable suspicions that an entrant has committed fraud, manipulation, has been dishonest or does not meet the entry requirements, they shall refuse to award the prize which has been won or disqualify the entrant.
8.5. In the event of an error, a misunderstanding or conflict in relation to the way any element of the Sweepstakes works, or with the behaviour of an entrant, the decision made by the Sponsor in this regard will be definitive and final.
8.6. The Sponsor reserves the right to take the necessary decisions to ensure that the Sweepstakes runs smoothly, with these being expressly accepted by all entrants.
8.7. In no way shall the Sponsor be responsible for the non-compliance or any type of infraction relating to this Sweepstakes and shall not be held liable in the event of losses suffered by entrants caused by the prizes or any other aspects of the Sweepstakes.
8.8. Likewise, the Sponsor shall not be held liable for damages suffered by an entrant arising from their enjoyment of the prize.
8.9. The entrant exempts the Sponsor of all liability and shall indemnify them against any claims as a result of the damages which may arise from activities carried out with the awarded prize.
8.10. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any entrant or potential winner to provide Sponsor with proof, to Sponsor’s satisfaction, that such party is the authorized account holder of the email address associated with the entry.
9.- OTHER CAVEATS
9.1. The Sponsor reserves the right to use the names, surnames and the images of the entrants, to reproduce them and use them in any advertising and promotional activities related to the Sweepstakes without this usage involving any right to payment or any type of benefits.
9.2. The Sponsor may use the names, surnames and images of the entrants on its web site and in other media as it sees fit.
10.- PERSONAL DATA [SPONSOR TO CONFIRM APPLICABILITY/ENFORCEABILITY IN THE US]
The data controller for your data Fantastec Sports Technology Ltd (company number 10757008). Your personal data will be processed for the primary purpose of managing your participation in the Sweepstakes, including the award of the prize, as well as for sending personalised commercial communications related Fantastec products and services.
In regard to the sending of commercial communications related to products and services related to Fantastec, provided that this is carried out by electronic means, it will be legitimate in terms of satisfying Fantastec legitimate interests in accordance with article 21 of Law 34/2002, of July 11, on information society services and electronic commerce, as well as the European Regulation on Electronic Commercial Communications.
Additionally, and providing you give us your consent, Fantastec will proceed to communicate your personal information to collaborators and sponsors of the club for the development of commercial activities (via email, mailing, fax, SMS, email and any telematic means) both of a general nature and those adapted to your personal characteristics. Personal information collected from entrants are subject to the Sponsor’s Privacy Policy, which can be found at https://www.swap-fantastec.com/privacypolicy.
We likewise inform you that Fantastec reserves the right not to use the content published by the participants when said content is inadequate or offensive. In no case will Fantastec take responsibility for the content published by the participants, being the participants the only ones responsible for the damages and losses that the inappropriate content of the profiles could cause Fantastec or any third party.
You may access, rectify and erase your data, or oppose certain uses thereof via email, as well as exercise other additional rights that are explained in the detailed data protection information by addressing an email to swap.support@Fantastec.io. 11. WINNER CONFIRMATION REQUEST: For a written confirmation of the winner (available after 03/13/23), send a stamped, self-addressed envelope (no later than 04/13/23), to: The Fantastec Slam Dunk Sweepstakes Winner Confirmation Request, PO Box 654, Social Circle, GA 30025-0654.
